This document outlines the terms and conditions under which, on one hand, arboquebecium.com, hereafter referred to as Arbo-Quebecium, provides its users access to the website and the services available on the website, and on the other hand, the manner in which the user accesses the website and uses its services. Any connection to the website is subject to compliance with these conditions. For the user, simply accessing the Arbo-Quebecium website at the URL www.arboquebecium.com implies acceptance of all the conditions described below.
Intellectual Property
he overall structure of the website www.arboquebecium.com, as well as the texts, graphics, images, sounds, and videos comprising it, are the property of Arbo-Quebecium or its partners. Any representation and/or reproduction and/or partial or total exploitation of the content and services offered by the website www.arboquebecium.com, by any means whatsoever, without the prior written permission of Arbo-Quebecium Inc. and/or its partners, is strictly prohibited and may constitute an infringement under the provisions of the Copyright Act (1985), c. C-42.
Online Nursery Purchases
Payment
Except for substantial orders or for customers without a PayPal account or credit card, plant purchases are exclusively done online. Arbo-Quebecium values its customers' security and trust. Therefore, the company has implemented an SSL certificate that ensures transactions take place in a completely secure environment. How does this work? First, by installing an SSL certificate, the company's identity is verified, and, most importantly, all information sent on the website is encrypted, making it indecipherable if intercepted. In summary, the risk of fraud is non-existent. As mentioned earlier, there might be exceptions to this process. Customers who cannot or do not wish to buy directly online can do so with a personal check. However, they must first send an email to the following address: info@arboquebecium.com, to inform the website administrator of the desired order. The administrator can then validate the purchase.
Plant Reservations
Throughout the year, plants are available on arboquebecium.com. However, no shipments are made between November 15th and April 15th. Shipping operations are therefore suspended for five months a year. However, as mentioned at the beginning of this paragraph, plants are available at all times. Customers who want to avoid the spring rush and ensure they can get the plants they wish to acquire can buy them up to five months in advance. Purchased plants will be sent as soon as weather conditions allow for their transplantation or when they become available. Regarding this, it is important to check the availability of the desired plants on the detailed page for each of them. Note that if a prepaid order includes, for example, a plant available at the beginning of spring (around April 15th) and another available only at the end of spring, the order will be shipped only at the end of spring (in May or June) to avoid two shipments, which would significantly increase the cost. Shipping
Plants are shipped in custom-made boxes. These boxes are 6" x 6" x 48" and can contain four plants with containers of 180 ml each or one plant with a one-gallon container. The sizes are all indicated on the detailed page of each product on the online nursery. To make the order profitable, it is recommended to fill the box(es) to full capacity whenever possible. In other words, when the buyer wants multiple plants with containers of 180 ml each, choosing a quantity divisible by 4 will be more cost-effective (4, 8, 12, 16, etc.). This does not apply to one-gallon containers, as only one fits in a box. Therefore, whether an order includes one, two, or three plants with one-gallon containers, it will not affect the delivery price. It's important to know that the boxes have a cost, and this cost is partly passed on to the customer. This charge is the same whether the box contains one or four trees with 180 ml containers. That's why it's advantageous to buy the smaller trees (180 ml size) in "quartets."
As for the actual shipping, it's handled by the company Canada Post. At the time of purchase, three delivery options are proposed. Indeed, the buyer can choose between standard parcel, Xpresspost, or Priority, which generally vary the delivery time between 1 and 3 business days. The customer is not required to be present during the delivery at their home - or any other chosen location - since the payment will already have been made.
Replacement Policy
At Arbo-Quebecium, quality is our foundation. This means that we are not at all hesitant to offer a return policy that will reassure and build trust with the customer from the start. So, for any plant that does not meet the customer's expectations, a replacement, with another plant of the same species and size, will be offered free of charge. Reasons that could justify such a request might include, for example, damage incurred during transportation or shipping of plants that were not part of the order and were mistakenly shipped instead of the intended ones. For the rest, it would be very unlikely for the plants sent to not meet the customer's standards, but if that were to be the case, they could also be replaced. In all cases, a photograph of the plant(s) to be replaced, a brief explanation of the customer's dissatisfaction, and the order number are required. The email address to use for a replacement request is: frederick.gladu@arboquebecium.com. The request must be made within a week of receiving the plants.
Arbo-Quebecium does not guarantee plants that may freeze and succumb during the first winter following their reception and transplantation. Too many factors in the health of the plants sold depend on the proper care provided by the customer, and for this reason, Arbo-Quebecium cannot guarantee that all plants from its nursery will thrive in your specific conditions. Therefore, it's up to the customer to double-check that the purchased plants can tolerate the biogeophysical conditions they will face once transplanted. These conditions could include hardiness zone (1, 2, 3, 4, 5), soil texture (clay, loam, sand), soil drainage, soil moisture (low, medium, high), site exposure (sunny, partially shaded, shaded), and plant tolerance to external agents they may encounter (white-tailed deer, compacted soil, recurrent floods, pollution, droughts, de-icing salts, etc.), to name a few. Note that to help you choose your plants, arboquebecium.com offers a search tool called "Search Filters," located on the left side of the screen when you are on the Online Nursery. Use it! As for other products offered by the nursery, such as seeds, for instance, there is no return or replacement policy. Nevertheless, Arbo-Quebecium values its customers' satisfaction and will do its best to find an amicable solution if any of its offered products (other than plants) is not deemed satisfactory by the buyer.
Order Cancellation or Modification
A customer who wishes to cancel an order must do so promptly by notifying the administrator as soon as possible. When an order is placed, it is recorded in the arboquebecium.com database. Even if the purchase amount has already been debited from your credit card or PayPal account, it may take a few hours for the order to be finalized. During these hours, the order is awaiting confirmation from the administrator. This is done online by validating the shipment with Canada Post. Generally, this operation is carried out in the evening. But this is indicative only. Confirmation of the order might occur earlier, and cancellation might not be possible. If cancellation is possible, the money from the order, minus 10%, can be refunded. This 10% is attributable to the PayPal commission, which generally varies between 3 and 4%. As a refund requires two financial operations (a deposit and a withdrawal), this commission would be between 6 and 8%. For this reason, Arbo-Quebecium cannot do anything and is obliged to retain 10% of the total transaction amount. Arbo-Quebecium also reserves the right to cancel any order at any time. In this case, no fees would be charged to the user. The reasons that could explain the cancellation of an order by the administrator could be an unforeseen out-of-stock situation, a typo, or an oversight in the price of an item, etc.
It is entirely possible to modify an order, but again, it must be done quickly. Substituting one product for another can easily be done, provided that they are of the same price and size. Otherwise, additional charges will apply. Deleting an item from the base order with a refund incurs a 10% fee on that item. Obviously, simply removing an item without a refund is free. Adding items to the order is also possible. The added product(s), as well as the associated shipping costs, will be listed on a new invoice, which will be sent via email to the user wishing to modify their order.
Once an order is placed on this website by a customer, they are presumed to have read, understood, and accepted the five points mentioned above, namely Payment, Plant Reservation, Shipping, Replacement Policy, and Order Cancellation or Modification, all of which are part of the Online Nursery Purchases section.
Registration, Username, and Password
Some features available on the website require registration or subscription. If you decide to register or subscribe to one or more of these features, you commit to providing truthful and up-to-date information about yourself and to ensuring that this information remains accurate and complete at all times. You acknowledge that you are responsible for:
- keeping confidential the passwords you choose after registration;
- any activity that occurs with your username and password;
- logging out at the end of each session;
- notifying arboquebecium.com of any unauthorized use of your username or password.
